I wouldn't bank on the date of 1928, if it were that simple, there'd be no need for lawyers and judges.

Bottom line is that if you make the arrangement and don't sell it and don't try to publish it, the copyright holder will never know or care that you arranged it. You can probably play it in most educational venues with never a problem. This happens all of the time.
