Legally, the material is protected even though it is out of print. For example, part of the reason it took so much effort to persuade Jay Friedman to re-release the CD of the CSO low brass was because the out-of-print LP had been copied so much.

Therefore, I would send Brandon to Harvey first. Harvey may well have a copy he can send out. If he doesn't, he'll know that at least one person still wants it.

If that doesn't work, then you'll have a better idea of the moral ground your are standing on, despite what the law says. Then you won't be so torn. You will have looked in the eye of the person who should benefit and given them the opportunity to receive that benefit.
