I know what a model release is. This would be relevant if the student took the picture. But, it's not clear to me that it applies here. Presumably there is a model release (pehaps only an implied one) covering the yearbook picture. Once the picture was published in the yearbook, it seems to me that the most relevant claim would be a copyright violation. Even with a model release, the student would still not have the rights to use *that* picture. With permission of the copyright holder, I don't think we have enough facts to know it a model release would be necessary. If the yearbook publisher used a boilerplate release, I suspect that it covered this use - and the only question is whether or not the publisher gave permission.

Again - it's a question of using the right claim, and the right mechanism to resolve the claim.
